All visual depictions displayed on this Web site are exempt from the record keeping requirements provision of 18 U.S.C. section 2257 and 28 C.F.R. § 75 for at least one of the following reasons: 

1. The depiction was made prior to July 3, 1995;

2. The image does not  contain any visual depictions of conduct specifically listed in 18 U.S.C section 2256 (2) (A) through (D) and was made before July 27, 2006; and/or

3. The image does not contain any visual depictions of sexually explicit conduct, as that term is defined in 18 U.S.C section 2256 (2) (A) through (E).

Moreover, the publisher of this Web site (EDG Systems, LLC d/b/a spyonguys.com) is exempt from any requirement of keeping, indexing or making available for inspection any records pursuant to 18 U.S.C. § 2257 because it is a member in good standing of the Free Speech Coalition, because its activities do not “ involve the hiring, contracting for, managing, or otherwise arranging for the participation of the depicted performer ” is protected by the preliminary injunction issued on December 28, 2005 in Free Speech Coalition, et al., v. Alberto Gonzales, No  CIVA05CV01126-WDM-BNB in the United States District Court for the District of Colorado, published at 406 F.Supp.2d 1196.
